A jury yesterday convicted Paul J. Elmer, the former CEO and owner of Pharmakon Pharmaceuticals Inc. (Pharmakon), of conspiracy to defraud the Food and Drug Administration (FDA) and nine counts of adulterating drugs, the Department of Justice announced today. Pharmakon was a Noblesville, Indiana, drug compounding facility.

Elmer, 67, formerly a licensed pharmacist and a resident of Fishers, Indiana, was charged by grand jury in a superseding indictment on Feb. 7, 2019. The superseding indictment charged that, from 2013 to 2016, Elmer and Caprice R. Bearden, Pharmakon’s former director of compliance, caused Pharmakon ─ which compounded sterile, intravenous drugs ─ to distribute approximately 70 lots of over- and under-potent drugs to military and civilian hospitals throughout the country.

“As these convictions show, the Department of Justice takes very seriously conduct that unlawfully undermines the safety of compounded drugs,” said Assistant Attorney General Jody Hunt of the Civil Division.

“We will not tolerate actions that impede the FDA’s efforts to ensure the safety of products. With its law enforcement partners, the Department of Justice will thoroughly investigate and prosecute those who knowingly prevent the FDA from protecting patients and ensuring compounded drugs are safe.”

The company did not disclose how it will price its shares when it begins selling them to public investors on the stock exchange, but reports indicate valuation at between $48 and $55 each, potentially giving the 10-year old firm a value of up to $100 billion, making it the biggest initial public offering this year.

Ron Rockwell Hansen, 58, a resident of Syracuse, Utah, and a former Defense Intelligence Agency (DIA) officer, pleaded guilty today in the District of Utah in connection with his attempted transmission of national defense information to the People’s Republic of China, after retiring from the US Army as a Warrant Officer with a background in signals intelligence and human intelligence.

He speaks fluent Mandarin-Chinese and Russian, and was hired by DIA as a civilian intelligence case officer in 2006, holding a Top Secret clearance for many years, having signed several non-disclosure agreements during his tenure at DIA and as a government contractor.

  During the course of his relationship with the agents of the Chinese intelligence service, Hansen received hundreds of thousands of dollars in compensation for information he provided them, including information he gathered at various industry conferences.

 Between May 24, 2016 and June 2, 2018, Hansen solicited from an intelligence case officer working for the DIA national defense information that Hansen knew the Chinese intelligence service would find valuable.

  Hansen advised the DIA case officer how to record and transmit classified information without detection, and explained how to hide and launder any funds received as payment for classified information.

Two Baltimore, Maryland men were sentenced today to life and 30 years, respectively, in prison for conspiring to participate in a drug distribution conspiracy and a violent racketeering enterprise known as Trained To Go (TTG),  The racketeering conspiracy included eight murders, as well as drug trafficking and witness intimidation.

Broughton, Harrison and their co-defendants were also convicted of a drug distribution conspiracy involving heroin, marijuana, and cocaine, with  Harrison participated in the murder of five individuals and a firearm recovered from Broughton was found to be used in four of those murders.

John Harrison, aka Binkie, 28, and Linton Broughton, aka Marty, 25, both of Baltimore, were sentenced by US District Judge Catherine C Blake to serve life in prison, and 360 months in prison, respectively, each followed by five years of supervised release.

“For years, John Harrison, Linton Broughton, and other members of the vicious Trained To Go gang brought death and violence to the streets of Baltimore,” said Assistant Attorney General Brian A. Benczkowski.

“We thank our hard-working prosecutors, as well as our federal, state, and local law enforcement partners, for their dedication in dismantling this vile gang”.
