President Trump has been discussing invoking martial law to overturn the results of the 2020 election and seizing supposedly fraudulent voting machines that — according to a wild conspiracy theory being pushed by people invited to the Oval Office to discuss the matter — were used to rob him of a second term, and all this during the final days of his presidency.

It has turned to be the most extreme example of Trump’s post-election behavior, which has grown more erratic and dangerous to our democracy by the day, leading to his supporters to storm the U.S. Capitol in protest while Congress voted to certify Joe Biden’s election victory.

How can he be stopped? 

More than 50 years ago, the framers of the 25th Amendment to the Constitution foresaw the possibility of a president’s behavior becoming so unstable that it would prove necessary to have some constitutional mechanism to remove him immediately from office. Section Four of that amendment provides a process for doing so: If the vice-president and the majority of the Cabinet decide that, for whatever reason, the president has become unfit to carry out the powers and duties of the office and they transmit a letter to Congress to that effect, then the vice-president becomes the acting president and remains so unless and until Congress refuses to allow that transfer of power to stand.

A Republican has confirmed again that he will be the first senator to object when Congress certifies US President-elect Joe Biden’s election victory next week.

Missouri’s Josh Hawley said he had election integrity concerns, despite a lack of evidence for widespread fraud.

A group of Republicans in the lower chamber of Congress, the House of Representatives, is also planning to contest the election results.

But the objections are not expected to change the outcome.

The US Electoral College – which confirms November’s presidential election result by aw.arding points for each state won by the two White House rivals – earlier this month cemented Mr Biden’s victory over Donald Trump by 306-232.

These votes must be affirmed by Congress on 6 January. Inauguration Day, when the new Democratic president and vice-president are sworn in, will be on 20 January.

Since losing the election, Mr. Trump has repeatedly alleged systemic voting fraud without substantiation. The Republican president’s legal efforts to overturn results have been rejected by the courts. Mr. Hawley said he could not vote to certify the electoral results “without raising the fact that some states, particularly Pennsylvania, failed to follow their own state election laws”.

“At the very least, Congress should investigate allegations of voter fraud and adopt measures to secure the integrity of our elections. But Congress has so far failed to act.”

Republican lawmakers have filed a lawsuit against Vice President Mike Pence to ensure he will determine which electoral votes will be counted when Congress meets in a joint session on January 6 to validate the results of the 2020 presidential election, the complaint revealed on Monday:
“Accordingly, Plaintiffs respectfully request this Court to issue a declaratory judgment finding that… Vice-President Pence, in his capacity as President of Senate and Presiding Officer of the January 6, 2021 Joint Session of Congress under the Twelfth Amendment… may exercise the exclusive authority and sole discretion in determining which electoral votes to count for a given State,” the complaint said.
The lawsuit adds that Pence must ignore provisions of the Electoral Court Act that would limit his exclusive authority to determine the Electoral College tally.
The lawmakers in the lawsuit want Pence to disregard the official Electoral College votes cast in Arizona, Georgia, Michigan, Wisconsin and Pennsylvania, and to rely on the alternate Electoral College votes submitted by Republicans. The complaint claims that there is evidence of massive election and voter fraud as well as acts of impropriety committed to benefit President-elect Joe Biden.
Republican electors in Georgia, Arizona, Nevada, Pennsylvania, Wisconsin and Michigan sent their votes to incumbent President Donald Trump in a challenge to Biden’s win in those battleground states.
