A Tennessee physician was sentenced today in the Western District of Tennessee to 20 years in prison for his unlawful prescribing of opioids that caused the death of one of his patients. According to court documents, Thomas K. Ballard III, 63, of Jackson, a medical doctor, owned and operated the Ballard Clinic, where he prescribed controlled substances outside the scope of professional practice and not for a legitimate medical purpose.

Officers with U.S. Immigration and Customs Enforcement (ICE) removed a Guyanese national, following his conviction and sentencing in the Eastern District of New York (EDNY) for his role in a mid-2000s plot to attack a New York international airport.
On Jan. 13, 2011, Compton Eversley, aka Abdel Nur, 70, was convicted and sentenced in a Brooklyn federal court to 168 months in prison for providing material support to a conspiracy that planned to attack the John F. Kennedy (JFK) International Airport in Jamaica, New York, by exploding fuel tanks and the fuel pipeline under the airport. Eversley believed the attack would cause extensive damage to the airport and to the New York economy, as well as the loss of numerous lives.
Eversely was admitted to the U.S. by immigration officials at the port of entry in Niagara Falls, New York, as a nonimmigrant visitor in March 1988. He was authorized to remain for up to six months but failed to depart in accordance with the terms of his admission.

A Houston-area pain clinic owner and a clinic employee who posed as a physician were sentenced to 240 months and 96 months in prison, respectively, today for their roles at a “pill mill” where they and their co-conspirator illegally prescribed hundreds of thousands of doses of opioids and other controlled substances.
Acting Assistant Attorney General Brian C. Rabbit of the Justice Department’s Criminal Division, U.S. Attorney Ryan K. Patrick of the Southern District of Texas and Special Agent in Charge Steven S. Whipple of the Drug Enforcement Administration’s (DEA) Houston Division made the announcement.
Baker Niazi, 49, of Sugarland, Texas, and Muhammad Arif, 62, of Katy, Texas, were sentenced by U.S. District Judge Alfred H. Bennett of the Southern District of Texas. Judge Bennett ordered that Niazi pay a fine of $500,000, and also ordered that Niazi forfeit $493,000 and that Arif forfeit $11,423.11.  Niazi pleaded guilty in April 2018 to one count of conspiracy to unlawfully distribute and dispense controlled substances, and Arif was convicted at trial in August 2019 of one count of conspiracy to unlawfully distribute and dispense controlled substances and three counts of unlawfully distributing and dispensing controlled substances.

A federal jury found a West Virginia doctor guilty today of unlawfully distributing opioids to his patients. The defendant was charged in a September 2019 indictment as part of the second Appalachian Regional Prescription Opioid (ARPO) Strike Force Takedown, a coordinated effort by the Justice Department’s Fraud Section to target unlawful drug diversion activities in areas of the country particularly hard-hit by the opioid epidemic.

Following a six-day trial, Ricky L. Houdersheldt, D.O., 68, of Hurricane, West Virginia, was found guilty of 17 counts of distribution of controlled substances outside the scope of professional practice and without a legitimate medical purpose. Sentencing is scheduled for Nov. 23, 2020, before U.S. District Judge Robert C. Chambers of the Southern District of West Virginia, who presided over the trial.

According to the evidence presented at trial, Houdersheldt prescribed hydrocodone, morphine, fentanyl, oxycodone, acetaminophen codeine phosphate, and diazepam to three patients which were outside the usual course of professional practice and without a legitimate medical purpose. Evidence at trial established that Houdersheldt prescribed more than 150 opioid pills to one female patient in an effort to establish a sexual relationship and companionship with her, and that in many instances he would meet her in parking lots – rather than at his medical office – to provide the prescriptions for these drugs. Evidence at trial also showed that Houdersheldt did not record these prescriptions in the female patient’s patient file for some of these unnecessary opioid prescriptions, and that many patients became addicted to the drugs as a result of Houdersheldt’s criminal conduct.

Operation Legend, named in honor of four-year-old LeGend Taliferro, who was shot and killed while he slept early in the morning of June 29 in Kansas City, was expanded as an sustained, systematic and coordinated law enforcement initiative in which federal law enforcement agencies work in conjunction with state and local law enforcement officials to fight violent crime. The Operation was first launched on July 8 in Kansas City, MO., and expanded on July 22, 2020, to Chicago and Albuquerque, to Cleveland, Detroit, and Milwaukee on July 29, 2020, and to St. Louis and Memphis on August 6, 2020.

“The most basic responsibility of government is to protect the safety of our citizens,” said Attorney General William P. Barr.

“Today, we have extended Operation Legend to Indianapolis, a city experiencing an increase in violent crime that no resident of that city should have to accept as part of everyday life. For decades, the Department of Justice has achieved significant success when utilizing our anti-violent crime task forces and federal law enforcement agents to enforce federal law and assist American cities that are experiencing upticks in violent crime. The Department of Justice’s assets will supplement local law enforcement efforts, as we work together to take the shooters and chronic violent criminals off of our streets.”

Attorney General Barr has directed the ATF, FBI, DEA, and U.S. Marshals Service in Indianapolis to dedicate resources to Operation Legend to help state and local officials fight high levels of violent crime, particularly gun violence.

Indianapolis is experiencing a significant increase in violent crime, with homicides currently up more than 51% and non-fatal shootings up more than 34%.
