A New York anesthesiologist identified as Anna Steiner, also known as “Hanna Wasielewska,” 63, of Valatie, New York, arraigned today on an indictment charging her for her role in an alleged telemedicine conspiracy to submit fraudulent claims to Medicare, Medicare Part D plans and private insurance plans.

As alleged in the indictment, however, Steiner and other providers signed prescriptions and order forms for DME and drugs that were not medically necessary and that were induced by kickbacks, and provided for beneficiaries whom Steiner and others had not examined and evaluated.

According to the indictment, starting in approximately January 2015, Steiner participated in a health care fraud scheme in which she and others ordered and prescribed durable medical equipment (DME) and prescription drugs in connection with purported telemedicine services.

Steiner, together with others, allegedly submitted or caused the submission of more than $7 million in claims to Medicare for DME on behalf of more than 3,000 beneficiaries; Medicare paid more than $3 million on those claims.

The owner of a Jacksonville, Florida-area substance abuse treatment center identified as Kyle Ryan Marcotte, 36, of Jacksonville Beach, Florida, pleaded guilty today for his role in a $57 million money laundering conspiracy associated with a pass-through billing scheme involving laboratory testing services, and as part of his guilty plea, agreed to a forfeiture judgment of $10,220,281.42.

According to admissions made as part of his guilty plea, Marcotte was the owner of a substance abuse treatment facility in Jacksonville Beach, Florida.  In approximately 2015, Marcotte entered into an arrangement with a laboratory owner to send urine samples for the facility’s patients to the owner’s lab for urine drug testing (UDT), in exchange for receiving 40 percent of the insurance reimbursements.  The lab owner, in turn, arranged with the managers of Campbellton–Graceville Hospital (CGH) and Regional General Hospital Williston (RGH), rural hospitals in Florida, to have the testing billed to private insurers through CGH and RGH and reimbursed at favorable rates under the hospitals’ in-network contracts with insurers.  Marcotte also admitted that he brokered deals with other substance abuse treatment centers to have their UDTs billed through CGH and RGH in exchange for Marcotte receiving 10 percent of the insurance reimbursements, while the other substance abuse facilities would receive 30 percent of the insurance reimbursements.

The ambassador had called the Trump administration “clumsy and inept”, and the  Trade Secretary Liam Fox’s scheduled meeting with the US Commerce Secretary Wilbur Ross in the US was cancelled, in another whiff of ice cold air blowing from Washington, D.C.

 He also falsely informed the victim that he would acquire the Ontario shopping center at a discounted price in lieu of a cash settlement, and that the victim needed to make payments for back taxes and overdue mortgage payments in order to acquire the property, and to make “unpaid court fees” to Ohanian even though no such fees were owed, court documents state.

 Ohanian also falsely informed the victim that he was representing the victim in a parallel bankruptcy proceeding involving the Ontario shopping center, and he provided the victim phony bankruptcy court pleadings, including orders that contained the forged signature of a United States bankruptcy judge, according to court documents.

Following a seven-day trial, Robert Glazer, MD, 73, of Los Angeles, California, the owner and operator of the Glazer Clinic located in Los Angeles, California, was found guilty of one count of conspiracy to commit health care fraud and 12 counts of health care fraud Co-defendant Marina Merino, 62, of Los Angeles, California, a marketer who recruited patients in exchange for kickback payments, was convicted of one count of conspiracy to commit health care fraud and eight counts of health care fraud.

Glazer also referred Medicare patients for a variety of services, including home health and hospice services, as well as ordered durable medical equipment that patients did not need or did not receive.

Homeland Security Investigations (HSI) Yuma special agents arrested Angel Leon-Camberos, 26, and seized 527.3 lbs. of methamphetamine (approximate street value of nearly $7.2 million), 14.88 lbs. of high grade marijuana and numerous wax (marijuana extract) products with an approximate street value of $103,930, one AR-15 style rifle, one magazine, packaging materials, multiple cell phones and $15,295 in cash in a targeted enforcement action lead by HSI.

Based on the quantity of seized contraband and the arrest, HSI special agents were contacted to continue the investigation. Based on the findings during the traffic stop and the subsequent investigation conducted by HSI special agents, a state search warrant was secured and executed at Leon-Camberos’ residence near Amarely Avenue that resulted in the additional seizure of 432.22 lbs. of methamphetamine, one AR-15 style rifle and one magazine, 14.88 lbs. of marijuana to include THC vape pens and approximately $15,295 in cash.

The defendant was presented and charged with multiple Arizona state drug charges including importation/transportation of dangerous drugs, misconduct involving weapons, and possession of narcotics for sale.

U.S. District Court Judge Laurie Smith Camp sentenced Sebastian Velasquez-Ramos, 47, to 28 months in federal prison following his criminal convictions for fraudulently using a Social Security card, falsely claiming U.S. citizenship, and aggravated identity theft. Velasquez-Ramos previously pleaded guilty to the charges.

An investigation determined that in 2017, Velasquez-Ramos used a false social security number, and he falsely claimed that he was a U.S. citizen to obtain employment at an Omaha company.

Velasquez-Ramos is also currently serving a separate prison sentence following a state conviction for leaving the scene of a fatal multi-vehicle crash. In April 2018, Velasquez-Ramos fatally hit a motorcyclist in Omaha and left the scene of the crash.

The 28-month federal sentence is to be served consecutively to the state sentence Velasquez-Ramos is now serving. In addition to his federal prison sentence, he must also complete three years of supervised release. There is no parole in the federal prison system.

Opioid manufacturer Insys Therapeutics agreed to a global resolution to settle the government’s separate criminal and civil investigations, the Department of Justice announced today.

As part of the criminal resolution, Insys will enter into a deferred prosecution agreement with the government, Insys’s operating subsidiary will plead guilty to five counts of mail fraud, and the company will pay a $2 million fine and $28 million in forfeiture.

As part of the civil resolution, Insys agreed to pay $195 million to settle allegations that it violated the False Claims Act. Both the criminal and civil investigations stemmed from Insys’s payment of kickbacks and other unlawful marketing practices in connection with the marketing of Subsys.

Insys’s drug Subsys is a sublingual fentanyl spray, a powerful, but highly addictive, opioid painkiller. In 2012, Subsys was approved by the Food and Drug Administration for the treatment of persistent breakthrough pain in adult cancer patients who are already receiving, and tolerant to, around-the-clock opioid therapy.
