CARTAGENA, Colombia – The US Immigration and Customs Enforcement (ICE), Homeland Security Investigations (HSI) receives computer forensics equipment from HSI Cyber Crime Center (C3) that will support criminal investigations in the city of Cartagena and the surrounding region. The creation of Transnational Cyber Crimes Investigative Laboratory (TC2IL) is critical to supporting the fight against the sexual exploitation of children and disrupting transnational crimes.

HSI Cartagena and the National Police of Colombia marked an important milestone in Cartagena’s fight against the cybercrimes that have impacted the community with the opening of TC2IL Sept. 28. During the inauguration of the TC2IL, HSI Operations Manager Randy Richardson, Assistant Attaché Antonio Crespo, and Regional Attaché Brian Vicente were awarded the Colombian National Police Directorate of Criminal Investigation and Interpol Medal for Meritorious Service. The medal signifies the significant contributions made by ICE-HSI to combat child exploitation in the region and securing computer forensic equipment pursuant to these critical efforts.

The forensic laboratory will strengthen the technical capacities of both the Colombian police and the prosecutors. The equipment will be used to combat the crimes where high-tech electronic means are necessary to obtain criminal evidence through data extractions. With this computer forensic equipment, experts can now mobilize to legally extract deleted and encrypted data from both mobile phones and laptops, among other equipment. TC2IL is the second forensic laboratory in Colombia supported by ICE-HSI and C3. The first lab, Yuliana Samboni Laboratory, was stood up in 2018 in Bogota, Colombia. This lab was created following the joint investigation of the abduction and murder of a Colombian minor, Yuliani Samboni.

“We thank the directorate of criminal investigation and Interpol for the commitment and collaboration to the investigative resources of computer forensics” said HSI Bogota Regional Attaché Brian T. Vicente. “We would also like to thank the Metropolitan Police of Cartagena for the space, logistical requirements, and especially the unwavering partnership. And lastly, to our ICE-HSI Cyber Crimes Center in Fairfax, Virginia, for the contribution of computer forensic equipment.”

C3 delivers computer-based technical services to support domestic and international investigations into cross-border crime. The Center specializes in cybercrimes, investigations of child exploitation, and computer forensics – to include evidence recovery. With this computer forensic equipment, HSI and their Colombian partners will not only focus on dismantling transnational criminal organizations that use cyber capabilities to further their criminal enterprise, but also track down child predators with the assistance from C3’s Child Exploitation Investigations Unit (CEIU). CEIU investigates producers and distributors of child sexual abuse material, as well as individuals who travel abroad for the purpose of engaging in sex with minors, also known as transnational child sexual abuse. CEIU employs the latest technology to collect evidence and track the activities of individuals and organized groups who sexually exploit children through the use of the dark web, chat rooms, peer-to-peer trading, and other internet-based platforms.

“As the world becomes increasingly digital, HSI’s top priority is to combat criminal activity conducted on or facilitated by the internet,” said Vicente. “With this forensic equipment, we will be able to work with our Colombian partners to investigate and rescue child victims from sexual exploitation, combat professional money laundering schemes, and more.”

The Department of Justice today awarded grants totaling $9.4 million to combat elder abuse and financial fraud targeted at seniors across the United States. Elder abuse is an intentional or negligent act by any person that causes harm or a serious risk of harm to an older adult. Attorney General William P. Barr announced the awards on the 30th anniversary of the International Day of Older Persons.

“Predators who target older citizens for fraud, financial scams and physical abuse are particularly despicable, turning the golden years of our nation’s seniors into a period of poverty and suffering,” said Attorney General William P. Barr. “The Department of Justice is taking aggressive action, pursuing all legal avenues to bring these criminals to justice and supporting law enforcement officials and service providers as they ferret out scam artists, arrest abusers, and bring aid and relief to victims.”

SIERRA VISTA, Ariz. – A local area man suspected of a drive-by shooting that left one man dead on Monday surrendered himself the following afternoon to local law enforcement. Multiple federal agencies, including U.S. Immigration and Customs Enforcement’s (ICE) Homeland Security Investigations (HSI), Douglas office, the U.S. Border Patrol, and the Cochise County Sheriff’s Office, assisted in this ongoing investigation.

Rick Martin, 20, of Sierra Vista, was taken into custody without incident and booked into the Cochise County Jail. Martin is charged with one count of first-degree murder, eight counts of aggravated assault, seven counts of attempted first-degree murder, four counts of endangerment, and two counts of misconduct with a weapon. The HSI Douglas Office has an agent assigned to the Sierra Vista Police Department Community Response Team who provided assistance with the crime scene and interviews.

“HSI is a proud partner of the Sierra Vista Police Department and is committed to working alongside local law enforcement to keep our communities safe,” said Scott Brown, special agent in charge for HSI Phoenix. “As a force-multiplier, this multi-agency effort resulted in the swift detention of the presumably dangerous suspect.”

“This was a dynamic case that moved quickly thanks to witnesses who remained on scene to provide valuable information,” Sierra Vista Police Chief Adam Thrasher says.

“We want to thank everyone who helped bring this case to a rapid resolution.”

The arrest stems from a drive-by shooting that occurred approximately 4:30 PM, Sept. 28, in the 900 block of Fry Boulevard. The driver of a red Honda coupe, later identified as Martin, shot at a black pickup truck as the vehicles traveled east along Fry Boulevard near Pizza Hut Bistro. The pickup truck then veered off Fry Boulevard and came to rest in a wash east of Pizza Hut Bistro.

The driver of the pickup truck, 18-year-old Sierra Vista resident Jorge Portillo, was shot one time in the head. Portillo was transported to Canyon Vista Medical Center and later died.

Ten men from around the country have been sentenced for participating in a child pornography enterprise and conspiracy, Acting Assistant Attorney General Brian Rabbitt of the Justice Department’s Criminal Division and U.S. Attorney William M. McSwain of the Eastern District of Pennsylvania announced today.

U.S. District Judge Harvey Bartle III for the Eastern District of Pennsylvania imposed the following sentences:

  • Andrew Dowdle, aka “Chigger,” 48, of Oswego, New York, was sentenced on Sept. 23, 2019, to 16 years in prison, followed by 15 years supervised release. He pleaded guilty on April 8, 2019.
  • Carl Masters, aka “Harmon,” 45, of Lawrence, Kansas, was sentenced on Sept. 24, 2019, to 27 years in prison, followed by lifetime supervised release. He pleaded guilty on April 25, 2019.
  • Ric Crossfield, aka “Officer Branner,” 25, of Jamaica, New York, was sentenced on Sept. 25, 2019, to 14 years in prison, followed by 40 years supervised release. He pleaded guilty on April 18, 2019.
  • Christian Brennan, aka “Choad,” 46, of Puyallup, Washington, was sentenced on Nov. 7, 2019, to 20 years in prison, followed by 10 years supervised release. He pleaded guilty on April 23, 2019.
  • Sharif El-Battouty, aka “Fritos,” 39, of Woodside, New York, was sentenced on March 16, 2020, to 30 years in prison, followed by lifetime supervised release. He was found guilty at trial on May 2, 2019.
  • Jarrett Lea, aka “Toot,” 27, of Charlotte, North Carolina, was sentenced on Oct. 1 2020, to 17 years in prison, followed by 15 years of supervised release. He pleaded guilty on April 15, 2019.
  • David Minnichelli, aka “Davis,” 30 of Califon, New Jersey, was sentenced on July 28, 2020, to 15 years in prison, followed by lifetime supervised release. He pleaded guilty on Oct. 22, 2019.
  • Marqueal Bonds, aka “The Goat,” 22, of Chicago, Illinois, was sentenced on Aug. 18, 2020, to 22 years in prison, followed by lifetime supervised release. He pleaded guilty on March 5, 2020.
  • Timothy Friel, aka “JJChuck,” 40 of Penndel, Pennsylvania, was sentenced on March 19, 2020, to 12 years in prison, followed by 15 years supervised release. He pleaded guilty on Aug. 24, 2018.

U.S. District Judge Benjamin H. Settle for the Western District of Washington imposed the following sentence:

  • Cory Crosby, aka “The 191,” 39, of Tacoma, Washington, was sentenced on April 1, 2019, to 25 years in prison, followed by lifetime supervised release. He pleaded guilty on July 18, 2018.

“The defendants collaborated in a sophisticated conspiracy to deceive, manipulate, and extort hundreds of unsuspecting and vulnerable children, tricking them into creating sexually explicit content by posing as their peers on live-streaming video chat applications,” said Acting Assistant Attorney General Brian C. Rabbitt of the Justice Department’s Criminal Division.  “These significant sentences reflect the Department’s commitment to uncovering such nefarious schemes and protecting our most innocent from exploitation by online predators.”

“Jarret Lea and his co-conspirators caused irreparable harm to over 170 identified child victims,” said U.S. Attorney William McSwain for the Eastern District of Pennsylvania.  “These men shrouded their true identities in the anonymity of the internet and presented themselves as their victims’ peers in order to gain these children’s trust and exploit them sexually.  The lengthy sentences handed out for this despicable behavior will not restore the innocence lost, but they do send a strong message that my office will find and prosecute child predators, no matter where they lurk.”

CHARLOTTE, N.C. – U.S. Immigration and Customs Enforcement (ICE) announced Monday that 12 criminal aliens were arrested in as part of a targeted enforcement operation by its Fugitive Operations Teams in Mecklenburg County, North Carolina, from Sept. 21 to 25. Six of these arrests included criminals with active ICE detainers who instead of being transferred into federal custody were released back into the community where they were free to reoffend until their capture.

ICE has repeatedly asked local jurisdictions to reconsider non-cooperation policies enacted in recent years because those policies put politics before public safety and release criminals back into communities where they are free to reoffend.

ICE maintains that cooperation with local law enforcement is essential to protecting public safety, and the agency aims to work cooperatively with local jurisdictions to ensure that criminal aliens are not released into U.S. communities to commit additional crimes. Unfortunately, Mecklenburg County and others continue to not only refuse to honor ICE detainers but to even notify ICE when it is releasing a potential public safety threat back into the community.

“We are here because we cannot stand by idly while knowing the public is being misled about the role ICE plays in keeping the public safe,” said ICE Executive Associate Director Henry Lucero. “The fact is local policies prohibiting agencies from working with ICE put you in danger and waste police resources. The public should hold its leaders accountable and demand to know what type of criminals are being released from local custody instead of turned over to ICE.”

3………….> Pirating $6 Million in COVID Relief Funds: North Carolina Man

A North Carolina man was charged with fraudulently seeking over $6 million in Paycheck Protection Program (PPP) loans, announced Acting Assistant Attorney General Brian C. Rabbitt of the Justice Department’s Criminal Division and U.S. Attorney Robert J. Higdon Jr. of the Eastern District of North Carolina.  

Tristan Bishop Pan, 38, of Garner, is charged with wire fraud, bank fraud, and engaging in unlawful monetary transactions. 

The indictment, unsealed today, alleges that Pan perpetrated a scheme to submit fraudulent PPP loan applications to federally insured banks.  The Small Business Administration (SBA) guarantees PPP loans under the Coronavirus Aid, Relief, and Economic Security (CARES) Act.  According to the allegations, Pan submitted numerous fraudulent PPP loan applications, including on behalf of entities named Pan Insurance Agency, White Walker, Khaleesi, and The Night’s Watch.  The indictment alleges that, in support of the fraudulent PPP loan applications, Pan made false statements about the companies’ employees and payroll expenses.  The PPP loan applications were supported by fake documents, including falsified tax filings, according to the indictment.  Pan allegedly submitted fourteen PPP loan applications seeking over $6.1 million and received more than $1.7 million in benefits following approval of the Pan Insurance Agency and White Walker PPP loan applications.  The government was able to seize some of the allegedly fraudulent loan benefits.

The CARES Act is a federal law enacted March 29.  It is designed to provide emergency financial assistance to millions of Americans who are suffering the economic effects resulting from the COVID-19 pandemic.  One source of relief the CARES Act provides is the authorization of up to $349 billion in forgivable loans to small businesses for job retention and certain other expenses through the PPP.  In April 2020, Congress authorized over $300 billion in additional PPP funding.

The PPP allows qualifying small businesses and other organizations to receive loans with a maturity of two years and an interest rate of one percent.  Businesses must use PPP loan proceeds for payroll costs, interest on mortgages, rent and utilities.  The PPP allows the interest and principal to be forgiven if businesses spend the proceeds on these expenses within a set time period and use at least a certain percentage of the loan towards payroll expenses.  

A criminal indictment is merely an accusation.  A defendant is presumed innocent until proven guilty beyond a reasonable doubt in a court of law.

The Donald Trump and Joe Biden campaigns have confirmed the candidates will appear at round two of the presidential election debates as the independent body responsible said it would look to change the format.

It comes as Wednesday’s fierce debate was labelled “the worst presidential debate ever”, filled with personal attacks and interjections.

Criticism and calls for change started rolling in before the first debate even ended, with the suggestion of a “mute button” gaining traction on social media.

Here’s what we know about potential changes, and what’s coming up for debate number two.

The Commission on Presidential Debates released a statement on Wednesday, saying the events are for the benefit of Americans.

“Last night’s debate made clear that additional structure should be added to the format of the remaining debates to ensure a more orderly discussion of the issues,” the statement read.

“The CPD will be carefully considering the changes that it will adopt and will announce those measures shortly.

“The Commission is grateful to Chris Wallace for the professionalism and skill he brought to last night’s debate and intends to ensure that additional tools to maintain order are in place for the remaining debates.”

The CPD hasn’t specified yet what the changes will be.

The 90-minute debate on Tuesday night has been described as chaotic and with constant interruptions and candidates straying away from the questions asked.

Biden suggested the use of a mute button while speaking at a campaign stop on Wednesday, saying he hoped organisers of future debates would be able to turn off the microphone of the candidate who is not speaking.

“It was a national embarrassment,” Biden said of the debate and Trump’s performance.

“I am not going to speculate what happens at the second or third debate.”

The mute button idea quickly gained traction on social media during and after the event.
