President Trump has been discussing invoking martial law to overturn the results of the 2020 election and seizing supposedly fraudulent voting machines that — according to a wild conspiracy theory being pushed by people invited to the Oval Office to discuss the matter — were used to rob him of a second term, and all this during the final days of his presidency.

It has turned to be the most extreme example of Trump’s post-election behavior, which has grown more erratic and dangerous to our democracy by the day, leading to his supporters to storm the U.S. Capitol in protest while Congress voted to certify Joe Biden’s election victory.

How can he be stopped? 

More than 50 years ago, the framers of the 25th Amendment to the Constitution foresaw the possibility of a president’s behavior becoming so unstable that it would prove necessary to have some constitutional mechanism to remove him immediately from office. Section Four of that amendment provides a process for doing so: If the vice-president and the majority of the Cabinet decide that, for whatever reason, the president has become unfit to carry out the powers and duties of the office and they transmit a letter to Congress to that effect, then the vice-president becomes the acting president and remains so unless and until Congress refuses to allow that transfer of power to stand.

A St. Louis resident was sentenced to 48 months in prison today for his role in a tax fraud scheme, as defendant Babatunde Olusegun Taiwo, co-conspirator Kevin Williams and others, engaged in a scheme to file false tax returns in the names of individuals whose personal identifying information they obtained without authorization. In particular, Taiwo, Williams, and others accessed from a data breach at a payroll company the information of hundreds of individuals, including school district employees in Alabama and Mississippi. The co-conspirators then used the information to file false tax returns with the Internal Revenue Service (IRS) that claimed more than $12 million in refunds, of which the IRS paid out $889,712.

“The Department remains committed to prosecuting those who use stolen identities to steal money from the United States by filing false tax returns and claiming fraudulent tax refunds,” said Principal Deputy Assistant Attorney General Zuckerman.

“As today’s sentence makes clear, there is a heavy price to pay for such criminal conduct.”
