The Department of Justice today announced that it has reached a settlement agreement with Sam Williamson Farms Inc. (SWF), a strawberry farm in Dover, Florida, resolving the investigation into whether SWF violated the anti-discrimination provision of the Immigration and Nationality Act (INA) by preferring to hire H-2A visa holders to harvest its strawberry crop instead of U.S. workers.

The Department of Justice’s independent investigation concluded that at the end of the 2016-2017 strawberry picking season, SWF informed its existing U.S. workers that it would rely instead on H-2A workers from a farm labor contractor to harvest its strawberries for the next season, and retained a farm labor contractor for the express purpose of obtaining workers with H-2A visas. Ultimately, the strawberry picking positions were filled by more than 300 H-2A workers and no U.S. workers. Refusing to recruit or hire available and qualified U.S. workers because of their citizenship status violates the INA.

“While H-2A workers can provide employers with necessary labor when there are insufficient numbers of interested U.S. workers, employers cannot deter or overlook qualified and available U.S. workers based on their citizenship status. This agreement reflects the Civil Rights Division’s continued commitment to protecting U.S. workers from discrimination,” said Assistant Attorney General Eric Dreiband of the Civil Rights Division.

Under the settlement, SWF will pay $60,000 in civil penalties to the United States, pay up to $85,000 in back pay to eligible U.S. workers, and conduct enhanced U.S. worker recruitment and advertising for future positions. The settlement also requires SWF to train employees on the requirements of the INA’s anti-discrimination provision and be subject to departmental monitoring and reporting requirements.

White House Remarks On Sanctuary Cities Policies:

Illegal immigration along America’s Southwest border surged 230 percent in April compared to last year, according to a report issued by the Department of Homeland Security earlier this month. That statistic accompanied news that a caravan of about 2,000 migrants from Central America started arriving at a U.S. port of entry in southern California.

Together, these reports reveal the lack of an orderly and fair process to manage the escalating flow of both illegal immigrants and asylum-seekers to the United States. That flawed system creates both a humanitarian and a national security crisis at our border.

Yet America’s immigration challenge does not end at our doorstep. Because of “sanctuary city” jurisdictions—many recently emboldened by new State laws in California—law enforcement officers face dangerous obstacles to protecting our communities from the effects of a broken immigration system.

Under the guise of being pro-immigrant, these jurisdictions privilege a small group of criminals at the expense of the safety and well-being of American citizens, law enforcement, and law-abiding immigrants.

Sanctuary cities are State or local jurisdictions that refuse to cooperate with Federal immigration enforcement, often by rejecting “detainer” requests from U.S. Immigration and Customs Enforcement (ICE) or refusing to tell ICE when criminal aliens are scheduled for release. If a suspected illegal alien commits a crime, ICE will issue a detainer to request that the jurisdiction notify ICE prior to releasing the criminal, that the criminal is held for up to 48 hours after their planned release to allow for questioning and possible removal, and that the jurisdiction safely transfers custody to ICE.

Three Southern California men identified as Jorge Vasquez, 58, of Fontana, the owner of H-2A Placement Services, a farm labor recruiting company based in Rancho Cucamonga; Melquiades Jacinto Lara, 62, of Santa Paula, the owner of J&D Harvesting, which contracted workers to farms in Ventura County; and Ricardo Mendoza Oseguera, 39, of Santa Paula, the owner of Discoteca Mi Pueblito, a music and convenience store in Santa Paula, which redeemed vouchers given to workers for J&D Harvesting after deducting fees from the workers’ pay, were arrested pursuant to a federal grand jury indictment alleging they participated in an immigration fraud scheme that, among other things, illegally charged Mexican nationals thousands of dollars to obtain H-2A work visas and additional money for expenses once they arrived in the United States.

The indictment alleges that Mexican farmworkers were charged illegal fees for transportation, room and board after the company arranging for the workers’ visas promised the U.S. Department of Labor (DOL) and U.S. Citizenship and Immigration Services (USCIS) that the workers had not paid and would not have to pay for these expenses. In addition, the indictment alleges that the farmworkers were made to pay fees to obtain their visas, which is prohibited under the H-2A visa program.
