A federal grand jury indicted a state-owned enterprise of the People’s Republic of China (PRC), a Taiwan company, and three individuals, charging them with crimes related to a conspiracy to steal, convey, and possess stolen trade secrets of an American semiconductor company for the benefit of a company controlled by the PRC government. All of the defendants are charged with a conspiracy to commit economic espionage, among other crimes. Also, the United States filed a civil lawsuit seeking to enjoin the further transfer of the stolen trade secrets and to enjoin certain defendants from exporting to the United States any products manufactured by UMC or Jinhua that were created using the trade secrets at issue.

“I am announcing that a grand jury in San Francisco has returned a multi-defendant indictment alleging economic espionage on the part of a state-owned Chinese company, a Taiwanese company, and three Taiwan individuals for an alleged scheme to steal trade secrets from Micron, an Idaho-based semiconductor company,” said Attorney General Sessions.

“Micron is worth an estimated $100 billion and has a 20 to 25 percent share of the dynamic random access memory industry—a technology not possessed by the Chinese until very recently. As this and other recent cases have shown, Chinese economic espionage against the United States has been increasing—and it has been increasing rapidly. I am here to say that enough is enough. With integrity and professionalism, the Department of Justice will aggressively prosecute such illegal activity.”

According to the indictment, the defendants were engaged in a conspiracy to steal the trade secrets of Micron Technology, Inc. (Micron), a leader in the global semiconductor industry specializing in the advanced research, development, and manufacturing of memory products, including dynamic random-access memory (DRAM).

The Federal Circuit Court of Appeals issued a precedential opinion today affirming the Court of Federal Claims decision that federal corporate taxpayers may not deduct as a cost of goods sold expense an excise tax expense that was never actually incurred or paid. In Sunoco, Inc. v. United States, No. 2017-1402, the Federal Circuit Court of Appeals affirmed the decision of the Court of Federal Claims and the position of the United States. Sunoco, Inc., a petroleum and petrochemical company, claimed approximately $1 billion in alcohol fuel mixture credits on its federal excise tax returns thereby reducing its federal fuel excise tax liability by the same amount. By including the $1 billion in excise tax expenses in its cost of goods sold, Sunoco, Inc. sought to reduce its federal corporate income taxes with an excise tax expense that was never paid. The Federal Circuit held that the plain language of the Internal Revenue Code precluded Sunoco, Inc.’s attempt to obtain a 300 million dollars “windfall” reduction in tax. The court also stated, “We have already established that Congress does not generally allow taxpayers to receive a tax benefit twice.”

A billion angry, underfed, undereducated, and underemployed children and young people could be loitering the open spaces of Africa by 2050, according to a new report published by the “African Report on Child Wellbeing” in Ethiopia’s capital Addis Ababa.

Graca Machel, chair of the Board of Trustees of the African Child Policy Forum (ACPF), an institution set up a decade ago by a decision by African heads of state and government says that the demographic risk is unavoidable, warning “unless governments commit to massive long-term investment in the nutrition, health, and education of their children and young people.”

New York investigative journalists have dug out a news report about Texas Democrats practically assisting illegal migrants at the US-Mexican border at the taxpayers’ expense, by using of a “prepaid card”   without disclosing it to the campaign management.

Project Veritas, a group known for undercover “sting” videos, has launched footage implicating Jody Casey, a campaign manager for Democrat Rep. Beto O’Rourke in Texas’ closely watched Senate race, and her team allegedly used campaign funds for undocumented caravan immigrants. The footage sports Jody reiterating “no comment” multiple times, while one of the campaign staffers, while Dominic Chacon, expressed determination to pick some immigrants up at the border as well as provide a supply of “food and blankets,” and give rides to Honduran “aliens.”
