A California man who was the chairman and managing partner of an energy company was charged in an indictment unsealed today for his alleged operation of a Ponzi scheme involving approximately 50 victims and more than $15 million.

Joey Stanton Dodson, 55, of Indio, California, was charged in an indictment filed in the Northern District of California with four counts of wire fraud, three counts of mail fraud and three counts of money laundering.

The indictment alleges that between November 2012 and May 2015, Dodson used several related companies and partnerships, collectively known as Citadel Energy, to fraudulently raise $15 million by soliciting investments in three limited partnerships that would purportedly provide water-related services to oil and gas companies in North Dakota

The indictment further alleges that Dodson induced investors by making numerous materially false misrepresentations about these partnerships, including regarding how the investor funds would be used, the amount of his compensation and the status of a potential acquisition of the partnerships by a private equity firm.

The superseding indictment also includes previously indicted co-defendants Cengiz Jan “CJ” Comu, John Mervyn Price, Harley E. “Buddy” Barnes III, Richard Lawrence Green and Daniel Thomas Broyles Sr. Comu, Price, Barnes, Green and Broyles are charged with one count of conspiracy to commit mail and wire fraud.

The superseding indictment alleges that, beginning in or around 2013 and continuing through in or around May 2019, the defendants participated in a scheme to defraud victims in the United States, the United Kingdom and Canada by fraudulently selling them stock in a company named EarthWater.

To induce victims to purchase EarthWater stock, the defendants falsely promised victims the opportunity to earn a high-rate of return in a short period of time by offering them stock at a low price on what they falsely claimed was the eve of EarthWater’s initial public offering (IPO).

31, 2019, Donald Andrew Rothman, 72, of Coral Springs, Florida, who was not charged in the original indictment, pleaded guilty to one count of conspiracy to commit mail and wire fraud as charged in an information for his role in the scheme.

Fatunmbi admitted that he and others paid cash kickbacks to patient recruiters and physicians for fraudulent prescriptions for DME such as power wheelchairs, which the Medicare beneficiaries did not have a legitimate medical need.
