Today the Senate began impeachment trial proceedings. Just a reminder that House Democrats completely failed to produce any evidence proving that President Trump did anything wrong. Now the Senate must reject this sham for what it is: A baseless political smear.

2…………..> Robing Medicare Recipients Scam: Big Pharma Slammed

Patient Services Inc. (PSI), a foundation based in Midlothian, Virginia, agreed to pay $3 million to resolve allegations that it violated the False Claims Act by acting as a conduit to enable certain pharmaceutical companies to provide kickbacks to Medicare patients taking the companies’ drugs by paying the patients’ co-payments, the Department of Justice announced today. The reason for that is when a Medicare beneficiary obtains a prescription drug covered by Medicare Part B or Part D, the beneficiary may be required to make a partial payment, which may take the form of a co-payment, co-insurance, or deductible (collectively, co-pays). Congress included co-pay requirements in these programs, in part, to encourage market forces to serve as a check on health care costs, including the prices that pharmaceutical manufacturers can demand for their drugs. The Anti-Kickback Statute prohibits pharmaceutical companies from offering or paying, directly or indirectly, any remuneration – which includes money or any other thing of value – to induce Medicare patients to purchase the companies’ drugs, and it prohibits third parties, such as copay foundations, from acting as a conduit for such payments.

“The Department is committed to ensuring that foundations are not used as mere conduits to funnel kickbacks from pharmaceutical companies to Medicare patients and to increase company profits while avoiding an important cost-control aspect of the Medicare program,” said Assistant Attorney General Jody Hunt of the Department of Justice’s Civil Division.

“We will continue to combat unlawful kickback arrangements and their pernicious influence on our health care system.”

3…………..> Trump’s Impeachment Charade: Report

The first full day of Donald Trump’s Senate impeachment trial was a 13 hours marathon, after which senators finally agreed to the rules that will govern how the rest of the trial plays out, and today, it’s expected we’ll begin to hear the opening arguments, which you can follow in our live blog below.

Schiff is still calling for witnesses and evidence, undeterred by the 11 votes against them yesterday, as he appealed to Republicans to “ensure a fair trial,” by voting to hear from witnesses and see documents he’ll be referring to throughout the trial.
Senate Majority Leader Mitch McConnell kept a provision in the organizing resolution that allows for witness and evidence votes after questioning.

The expected timeline is as follows:

3 days of opening arguments from the Democratic House Managers
3 days of opening arguments from Trump’s defense team (starting on Saturday US time.
16 hours (most likely two days) of questioning from the Senators, then votes on witnesses and evidence. At this point, there’s nothing to suggest Republicans will change their minds and let that happen.

4……………> China Coronavirus Scare: Deaths Surge

Chinese authorities have urged people to stop traveling in and out of Wuhan, the city at the center of a new virus outbreak that has killed 17 people, and those living in the city of 8.9 million people have also been told to avoid crowds and minimize public gatherings.

The new virus has spread from Wuhan to several Chinese provinces, as well as the US, Thailand and South Korea, with 440 confirmed cases, with the origin a seafood market that “conducted illegal transactions of wild animals”, as authorities confirmed the number of dead had almost doubled – from nine – in the space of a day. All fatalities so far have been in Hubei, the province around Wuhan.

Officials in Hong Kong also reported the territory’s first two cases.

Meanwhile, in Geneva, the World Health Organization’s emergency committee is meeting to assess the global risks posed by the virus and decide if it should be declared an international public health emergency – as happened with swine flu and Ebola.

5…………> You Ain’t Welcome Here: Trump’s New Travel Ban

President  Trump said he plans to add countries to his existing travel ban to bar more foreign nationals from entry into the US, an expansion of the current ban – signed by him two years ago – closed US borders to citizens from seven countries, most with Muslim majorities, including Libya, Iran, Somalia, Syria, Yemen, North Korea and Venezuela countries from EU, Asia and Africa are also considered.

Mr. Trump confirmed that more countries will be added:

“You see what’s going on in the world, our country has to be safe,” he told reporters at the World Economic Forum in Davos, Switzerland on Wednesday.

In June 2018, the Supreme Court upheld Mr. Trump’s ban, rejecting findings from lower courts that deemed the ban unconstitutional.

2………….> World War 3: Live On Capitol Hill

The President’s personal lawyer Jay Sekulow and White House Council Pat Cipillione aren’t directly addressing Schiff’s arguments, but rather recycling a lot of the Republican talking points about the process of the impeachment investigation rather than the substance of it.
Some of their statements are false.

Schiff just finished talking, making an argument for why the Senate should vote against the organizing resolution or add amendments, focusing on 1) the need to call witnesses and 2) the need to admit additional evidence.

“The facts will come out in the end. The documents, which the president is hiding, will be released through the FOIA or through other means over time. Witnesses will tell their stories in book and film. The truth will come out. The question is, will it come out in time?”

The bulk of his points rest on the precedent set by Bill Clinton’s trial (which led to his acquittal).

Republicans have publicly said they’re aiming to follow the Clinton precedent, but there’s a key difference between the two trials, making it a bit like comparing apples to oranges.

In the Clinton case, the investigation into his misconduct (known as the Starr Report) was finished and made public before politicians started pushing for impeachment, let alone launch an impeachment inquiry.

In the case of Donald Trump, the investigation into the Ukraine scandal started after the Democrats launched the impeachment inquiry and happened on a much shorter timeline. Hence why evidence is still coming out.

3……………> NRA Diehards vs Virginia Communists: The Motion Picture

For the first time in 26 years, Virginia is headed by Democrats at all three branches of government, and several of the Democrats that displaced Republicans this November ran on gun control platforms, by proposing 10 gun control measures, voted on four and advanced three mandate universal background checks, limit handgun purchases to once a month and prevent cities from creating gun laws that conflict with the state’s — are expected to pass in February and take effect in July.

Hal Miller took bus and rode 110 miles state to Capitol building in Richmond, Virginia, with a message for politicians: “Don’t take away Virginia’s guns. We’re not gun owners, but I think what’s going on in Richmond today is a violation of this constitution. Guns are a civil right,” he said.

4……………> The Fateful Pre-Hitler Years: Babylon Berlin Part 2

On January 24, the third TV season of Babylon Berlin will be launched on Sky. Berlin tourists are showing great interest in the 1920s and the many film locations that still have the flair of this golden age.
A good starting point for a trip back in time to the Berlin of the Golden Twenties is the former silent movie theater Delphi dating from 1929, which is one of the most important film locations for Babylon Berlin. In the TV series, it depicts the famous Berlin dance hall Moka Efti, which was destroyed during the war. Today the Delphi cinema regularly hosts theater and music performances.

2…………..> ICE National Security Efforts vs New York Saboteurs Politicians

ICE served four immigration subpoenas Friday on the New York Department of Corrections (NYDOC) requesting information on multiple illegal aliens who were criminally arrested in New York City, and yet under New York’s non-cooperation policies officials have refused to honor ICE detainers or even provide ICE with information about the release dates of criminal alien public safety threats.

“Like any law enforcement agency, we are used to modifying our tactics as criminals shift their strategies; but it’s disheartening that we must change our practices and jump through so many hoops with partners who are restricted by sanctuary laws passed by politicians with a dangerous agenda,” said Henry Lucero, acting Deputy Executive Associate Director for ICE’s Enforcement and Removal Operations.

ICE is using every tool available to obtain information regarding the whereabouts and other relevant information regarding removable aliens from jurisdictions that chose to, or are unable to, cooperate with ICE. The criminal aliens about whom ICE sought information from NYDOC include:

A 21-year-old unlawfully present Guyanese national, who was arrested on January 10, by the NYPD and charged with murder, sexual abuse, contact by forcible compulsion, and sexual abuse of a 92-year old woman. He was previously released from local law enforcement custody in November 2019, despite ICE having lodged a detainer against him, due to New York City’s sanctuary policies;

A 26-year-old citizen of El Salvador who was arrested in September 2019, for assault and is wanted in El Salvador for homicide. He was moved to Rikers Island, and ICE lodged a detainer against him. However, ICE is actively attempting to locate him in the community because he was released by NYDOC in December.

3…………..> World War 3: Live On Capitol Hill

With the ceremonial opening out of the way, Donald Trump’s Senate impeachment trial begins in earnest today. After a debate over a resolution dealing with the rules of the trial, we expect to get into the opening arguments.
Quick recess before amendment debate gets under way.
There’s a good chance the Republicans are huddling over how to respond.
Schumer needs 51 votes to pass this amendment, which means four or more Republicans and every Democrat would need to vote in favour of the measure, and proposed an amendment.
It’s about subpoenaing documents from the acting White House Chief of Staff Mick Mulvaney, Vice President Mike Pence, Former National Security Advisor John Bolton and other Trump administration officials. All documents seem to relate to communication between the White House and Ukraine.
It’s more specific than I expected, and I’m curious to see if the debate that follows this amendment gets more specific, too.

4……………> Japan’s Prison System: A Dark Shadow Of Its Past?

Japan has been accused for many years following WW2 by Human Rights Watch, and other “crimes against humanity” watchdogs of running a overly rigid prison system designed to coerce confessions, with reports abound of inmate beating and torture, now denied by its Minister of Justice, as Australian journalist Scott McIntyre spoke of his cell being lit for 24 hours straight, making it impossible to sleep more than an hour each night, and that several of his fellow detainees told him they would confess to crimes they had not committed to shorten their time there..

The former SBS journalist also said he had not seen his children in over 250 days, upon his exit from prison and called on the Japanese Government to modernize a system of joint custody.

5…………> Radioactive Capital Of The World

Jachymov, a small uranium mining town in the northwest of the Czech Republic, has been destined to be the the birthplace of radioactivity research,  as trail-blazing Nobel Laureates Marie Sklodowska, Pierre Curie and Henry Becquerel based their revolutionary work on radioactivity on material brought from there. It also became a birthplace of radium mass hysteria and a center of unconventional radon health baths.
